| | Can I have more info in land purchase which my land is vacant land, we buy it for future planning to construct a University. Category : Buying Property in Malaysia Location : Johor the price for the land is RM14,000,000. We expect to give the down payment for RM 4,000,000 and loan from bank RM 10,000,000. I was told by bank that since it is vacant land for temporary, i was offered by BLR + 0%. I do not know whether this is best rate offered. And also, the bank said no package for purchasing a land, unlike housing loan package.
Please advise or any bank offered better rate?

| | Consent from purchaser for developer to encumber property for bridging financing? Category : Buying Property in Malaysia Location : Johor I was recently presented with a Sales and Purchase Agreement, for purchasing a landed property in Malaysia to be constructed, which included a consent form for purchaser to allow developer to charge the land for bridging loan facilities. Understand this is allowed under Schedule G of the Housing Development (Control and Licensing) Act 1966.
Although we had signed the SPA but the consent form was left unsigned, as effects of allowing such encumbrance was not explained to us as purchasers at that point in time.
Question:
Although the charging of land by developer for bridging loan financing is provided for under Schedule G, is required by the developer, and is apparently not against the Housing Development Act 1966,
- is such consent for encumbrance by the purchaser deemed mandatory under the contract and is an integral part of the SPA, such that if the purchaser does not provide such consent, then the SPA signed by purchaser will be aborted / cancelled naturally by law?
- Or such SPA may still have legal effect and developer has no discretionary right to abort / cancel such contract? Or in other words, does the developer have such right to abort / cancel SPA that has already been signed by purchaser, just because the consent for encumbrance form is not signed?
- When purchasers really want to go ahead with the purchase, does purchasers really have the option in deciding whether or not to provide the 'consent for encumbrance'? In other words, does purchasers have the right to require the developer to go ahead with the signed SPA but without giving consent for developer to charge the land / property for bridging loan facilities?
- Does the developer have the right to delay processing such SPA?

| | property ownership transfer privately Category : Legal and Finance Location : Johor Hi,
I would like to know if it is common to have property ownership transfer with some sort of agreement or deed within 2 party. If i have a friend who has been allocated a house during billeting but decided to forgo the chance to me privately, is there any legal agreement or deed as a proof of giving up interest of property. If go by the proper process, it will cost more for the property price compared to the first order price.
Besides, can i be the co-owner of the property? any process is needed? can i apply the housing loan from bank as a co-owner? for instance, get the housing loan under my name instead of my friend.
